This Privacy Notice describes what personal data we collect about you as a data subject and how we use it.

The purpose of this Privacy Notice is to set out the lawful conditions and framework for all processing activities involving personal data carried out by Biotek Ltd as data controller and to facilitate the secure processing of data, preventing and hindering any unauthorised or unlawful processing.

Biotek Ltd. is entitled to unilaterally change the contents of this Notice at any time without prior notice. The current and the amended Prospectuses are available on the website of Biotek Ltd.

Biotek Ltd. as the data controller is responsible for the processing and security of personal data provided by data subjects in accordance with applicable data protection legislation.

Place of data processing:

Your data will be stored at the headquarters of Biotek Kft. or on external servers operated in Hungary. The data may be transferred to our suppliers in the European Economic Area, either with your consent or to fulfil a legal obligation.

Legal basis for processing:

- In connection with the establishment, maintenance or possible termination of a contract between the Customer and Biotek Ltd (contractual legal basis);

- The processing is required by law (legal obligation);

- You explicitly consent to the processing of your personal data for a limited purpose (consent);

- Biotek Ltd has a legitimate interest in the processing which is not overridden by your interests, fundamental rights and freedoms that require the protection of your personal data (legitimate interest).

Purpose of the processing:

We process personal data about our Clients or data subjects only in accordance with the specified purpose for which the data was originally collected. The primary purpose of our data processing is to contact our Clients in order to perform contracts concluded or to establish and maintain such contracts. In addition, the purpose of processing may be to comply with legal obligations (e.g. accounting law requirements) and to protect the personal data and property of our Clients and employees on the basis of legitimate interests.  In order to provide the highest quality of service to our Customers, Biotek Ltd. will also use the data, with your consent, for the purposes of providing business offers, marketing and advertising.

Biotek Ltd. will process personal data only to the extent and for the time necessary to achieve the purpose of the processing, taking into account the legal requirements and the interests of the data subjects.

Once the conditions set out in the legislation and/or the purpose ceases to exist, the data will be deleted, blocked, in some cases pseudonymised or anonymised.

Consent to the processing of personal data:

When you request consent, we will provide you with the following information:

a) the purposes for which consent is sought or deemed to have been given;

b) the right to withdraw consent; and

(c) other relevant information necessary for the data subject to make an informed decision about the processing of his or her personal data (e.g. the nature of the personal data processed, the categories of personal data processed, the third parties who may have access to the personal data (if any) and how data subjects can exercise their rights).

The scope and source of the personal data processed:

In relation to our Clients, we process only the data necessary to contact the Clients, such as the name of the data subject, his/her work telephone number, e-mail address. If the customer of Biotek Ltd. is a natural person, the billing or shipping address provided by the data subject may also be considered personal data. Biotek Ltd. processes personal data obtained directly from Customers or found in public databases and retrieved from there.

Access to data by third parties:

Your personal data may be accessed by Biotek Ltd's IT service partners. These Biotek Ltd. partners may access your data only to the extent and for the duration necessary for the performance of their IT functions, and such access does not constitute a transfer of data.

Biotek Ltd may share contact information for the purposes of warranty/warranty fulfillment or, with the consent of the data subject, for manufacturer product support.

If the delivery of the ordered products is carried out by a contractual carrier partner of Biotek Ltd, the contact details of the data subjects will be transferred to the carrier partner in order to fulfil the order and deliver the products.

Biotek Ltd. provides the contact details of the subscribers to the newsletter to SendInBlue, which provides the software platform for sending the newsletter.

Biotek Ltd. requires all its partners who have access to data subjects' data to comply with the applicable data protection legislation.

Data retention period:

The data processed in connection with the performance of contracts will be kept for 5 years after the performance of the contract, in accordance with the general limitation period pursuant to Section 6:22 (1) of Act V of 2013 on the Civil Code.

The data on accounting vouchers are kept for 8 years after the voucher is issued (statutory data processing).

Contact details processed on the basis of your consent will be stored until you request their deletion.

Your rights regarding your personal data:

- Right of access:

 We will provide information upon request:

a) the personal data we process or hold about you;

(b) who may know or have known the data and for what purposes, and whether there has been a transfer or disclosure of the data to a data controller;

(c) the legitimate purposes for which the data are processed;

(d) where possible, the period for which the personal data are stored, or, if this is not possible, the criteria for determining that period;

e) the source of the personal data, if the personal data have not been collected from you.

In addition to the feedback, we will provide you with the following information at your request:

(a) information that you may at any time request the rectification or erasure of your personal data and the restriction of the processing of your personal data, and object to the processing of your personal data;

(b) how to lodge a complaint with the NAIH;

(c) the possibility of judicial remedy.

- Right to rectification, amendment:

You may request the correction of your personal data if it is incorrect.

If you have Client Gate Access, you can view and amend your registered personal data in the profile settings.

- Right to restriction.

You have the right to request restriction of the processing of personal data concerning you if

a) dispute the accuracy of your data for the period necessary for Biotek Ltd to verify the accuracy of the data;

b) unlawful processing;

c) you have objected to the processing of your data recorded for legitimate interests, pending the determination of the existence of legitimate interests of Biotek Ltd.

The restriction of the processing of your personal data may affect the services provided by Biotek Ltd.

During the restriction of processing, personal data, except for storage, may be processed only with the consent of the data subject or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person.

- Right to object

You have the right to object, at any time, on grounds relating to your particular situation, to the processing of your personal data carried out in the public interest or necessary for the purposes of the legitimate interests pursued by Biotek Ltd or a third party.

You also have the right to object to the processing of your personal data on the basis of legitimate interests, unless Biotek Ltd can demonstrate compelling legitimate grounds for the processing which override the legitimate interests pursued by the processing or for the establishment or defence of legal claims.

- Right to erasure:

You have the right to request the erasure of personal data relating to you where

a) your personal data is no longer necessary for the legitimate purposes for which it was collected or otherwise processed;

(b) the processing was based on your consent and you withdraw your consent and there is no other legitimate purpose for the processing;

c) you successfully object to the processing of your personal data;

(d) your personal data have been unlawfully processed; or

(e) your personal data must be erased in order to comply with a legal obligation.

- Right to object to direct marketing.

- Right to data portability

You have the right to receive the personal data provided to Biotek Ltd. in a structured, commonly used, machine-readable format if:

a) the processing is based on your consent; or

b) the processing is based on the performance of a contract with you; and the processing is carried out by automated means.

You can exercise the above rights by sending an email to info@biotek.hu, but our customer service staff are also available to help you using the contact details on our website. Biotek Ltd. will reply to your request without delay and at the latest within 30 days from the date of the request.

- Legal remedies:

If you allege a violation of your data protection rights, please contact us at our contact details in the first instance.

If you believe that your rights have been infringed or there is an imminent threat of such infringement in connection with the processing of your personal data, you may initiate proceedings before the National Authority for Data Protection and Freedom of Information. The contact details of the Authority can be found on the Authority's website. (http://www.naih.hu/uegyfelszolgalat,--kapcsolat.html). In addition to the above, in the event of a breach of rights, you have the right to take legal action before a court, which will normally be the court of the defendant's domicile, but you may also choose to bring the action before the court of the place of your residence or domicile.

Additional information for customers with a Client Account:

In case of client gateway access, your personal data will be stored as you have consented. You can view and modify the personal data we hold about you in your profile settings.

By requesting registration, you consent to us sending you information about our product news or professional events by direct marketing means (e.g. newsletter) to the contact details you have provided. You can withdraw this consent at any time and unsubscribe by going to the "Newsletter" section of our website or by opening the link at the bottom of the newsletters.

Please note that when using the 3D download function on the Customer Portal, the contact details (name, e-mail address) you provide will be transferred to the manufacturer. By using the 3D download function, you expressly consent to the transfer of your data.

You can request the deletion of your Client Gateway access data at any time by sending an email to info@biotek.hu, in which case your Client Gateway access will be deleted.

Additional information for job applicants: 

By submitting an application for a job advertised by Biotek Ltd, applicants acknowledge that they have read and accept Biotek Ltd's privacy policy. By submitting an application for a vacancy, the applicant expressly consents to the processing of personal data provided in the application by Biotek Ltd. as set out in this notice.

Applications submitted to Biotek Ltd will be stored at Biotek Ltd's headquarters. The applications will be handled by the Managing Director and the prospective line manager of the advertised position, but the applicant acknowledges that the data provided in his/her application may be accessed by any of Biotek Ltd's staff or by its IT service partners.

Submitted applications and any personal data relating to unsuccessful applicants will be destroyed no later than 6 months after the end of the recruitment period or after the position has been filled.

Electronic monitoring system: 

For security and crime prevention reasons, we operate a video surveillance system at our premises at Bökényföldi út 104, 1165 Budapest, Hungary. In addition to recording video footage, the system also records the number plates of vehicles entering the premises.

Your image may be captured during the video surveillance. The processing of the data is based on the legitimate interest of Biotek Ltd. for the safety of our employees and our customers and to prevent abuse. The recordings can be accessed by our partner operating the camera and number plate recognition system as a third party.

The video recordings are stored for 15 working days, after which they are deleted, unless their further use is necessary for abuse.

Use of cookies:

A cookie is a small text file that is stored on the hard drive of your computer or mobile device and is activated on subsequent visits. Accepting or authorising the use of cookies is optional. You can refuse the use of cookies through the settings on your computer or other browsing device or the browser you use to access the website, but you will not be able to take full advantage of all the features of our website without cookies.

Cookies store technical information, this information does not allow the visitor to be identified personally. We will only link your cookie ID to the information you provide when you register with the Client Portal if you are logged into your account.
